Area 02 · Advice and representation
Environmental law
Supporting economic activities and public decisions where permits, environmental conditions and health protection affect the ability to operate.
How we assist
Administrative procedures and permits
Legal support in environmental permitting and assessment procedures, including integrated environmental authorisations (AIA), single environmental authorisations (AUA) and environmental impact assessments (VIA). Analysis of imposed conditions, requests for additional information and changes to operations; preparation of observations and submissions, participation in the administrative process and assessment of final decisions.
Remediation and contaminated sites
Reviewing contamination-related obligations and liabilities, the positions of owners and responsible parties, orders and required interventions. Support in reconstructing the records and relationships between authorities, operators and technical advisers, including sites of national interest and complex intervention programmes.
Operations and risk prevention
Legal assessment of waste management activities, conditions applicable to facilities and contractual arrangements within the supply chain. Coordination of environmental safeguards with business organisation and, where relevant, the crime-prevention model under Legislative Decree 231/2001. Technical assessments are integrated into the legal process through cooperation with the appropriate professionals.
Inspections and litigation
Assistance with inspections, compliance notices, allegations and measures affecting operations. Assessment of reasoning, proportionality and protective remedies. Representation in relevant administrative and civil disputes, with attention to technical documentation and the relationship between environmental protection, health and business continuity.
Illustrative example
A new condition affecting facility operations
An operator faces new environmental conditions requiring work on its facility. Assistance may begin with the permit, technical assessments and the procedure followed by the authority, then examine the substance, timing and responsibilities of compliance. Working with technical advisers makes it possible to prepare documented observations and identify any grounds for legal protection.
