Area 03 · Advice and representation
Healthcare law
Advice and representation in healthcare, where organisation, resources, contracts and the protection of individuals require a coordinated legal approach.
How we assist
Authorisation, accreditation and agreements
Assistance in relationships between healthcare facilities and public authorities concerning operating authorisations, institutional accreditation and contractual agreements. Analysis of requirements, conditions, inspections and measures affecting operations and the provision of services within the public healthcare system.
Services, reimbursement and financial disputes
Reviewing budgets, expenditure ceilings, reimbursement of services, tariffs and diagnosis-related groups (DRGs). Assistance with payment disputes, verification of contractual entitlements and evidence of receivables, relationships with assignees and financiers, and disputes over payment deadlines and conditions.
Organisation and responsibility
Advice on organisational structures, internal rules and procedures in healthcare bodies and facilities. Assessment of relationships with staff, professionals and suppliers and of liability arising from management decisions. Where clinical or specialist investigations are required, legal work is coordinated with the relevant technical advisers.
Data, digital services and individual rights
Assistance with the legal aspects of health-data processing, consent and information, telemedicine and services outsourced to digital suppliers. Coordination of data protection, cybersecurity, service continuity and facility responsibilities, including review of contracts, procedures and the allocation of roles.
Illustrative example
A payment claim for healthcare services
A public body receives a payment claim for services supplied by an accredited facility. Assistance may include reviewing agreements, financial limits, evidence of the services and any assignment of receivables. That assessment informs objections, opportunities to resolve the relationship and litigation strategy, while distinguishing institutional accreditation from the legal basis governing the individual claim.
